At a "ball park" you may assume the risk of being hit by a ball. But you certainly don't assume the risk of being hit by a bat. There's rules about bat etiquette for a reason. Edit: This bat did not break.

The difference between the speed of a baseball at the netted stands and the far outfield is massive. Going off baseball dimensions, air resistance, and speed, the netted section near home plate the ball is moving 85-115 MPH. By the time it reaches the outfield stand it's moving 45-65 MPH. That's why the netting exists so close. If the netting can't stop a heavier slower moving bat, it can't stop a ball.

If the net cant catch a ball before it hits somebody then its clearly an inadequate net. Additionally "assumption of risk" applies to flyaways, which move much slower and is much less damaging than a direct hit.

The fact that they have higher netting one section over is a clear sign they knew “we need a taller net to prevent accidents in this area.” You can’t say “we had the netting” if you have taller netting right next to where she was sitting. That shows they saw that section as higher risk. Why would you suddenly cut the height just a few seats over from there if you’re already acknowledging that that section of the stadium is a high risk zone for foul balls and lost bats?

There’s a very famous picture of Red Sox player Jim Rice holding a little boy who’d been hit by a foul ball at Fenway in the 80s. The little boy had blood streaming down his face, it’s a haunting image. Apparently the little boy had been sitting next to the Red Sox dugout with his dad and brother when he was hit. Rice immediately scooped the boy up and ran inside the dugout to the team doctor, the family following close behind. Within minutes they were able to get the boy to Children’s Hospital down the road
